Privacy Policy

Scope

This Privacy Policy applies exclusively to the collection and processing of personal data performed by Campos Ferreira, Sá Carneiro & Associados – Sociedade de Advogados, R.L. (“CS Associados”) on the Platform.

On the website of CS Associados, on the Platform and/or their contents, Users may find links to other websites. CS Associados is not responsible for the contents of such websites, nor for the respective personal data collection practices, this Privacy Policy therefore not being applicable to the same.

Third-party websites may have their own privacy and customer service policies, and therefore browsing and interacting with such websites is subject to the respective terms and conditions.

Personal Data

Pursuant to Article 3 of the Personal Data Protection Act (Law 67/93, of October 26), as amended, “Personal Data” is any information, of whatever nature and regardless of the respective format, including sound and image, relating to a natural person identified or identifiable (the data subject). A natural person is considered to be identifiable if such person can be directly or indirectly identified, including with reference to an identification number or to one or more specific elements of its physical, physiological, psychological, economic, cultural or social identity.

Purpose of Data Collection

The security and confidentiality of the Platform and of its contents require that only duly identified and registered Users are granted access.

For these reasons, solely Users that successfully complete the registration procedure on the Platform and have set-up a User Account may benefit from authorisation to access the Platform. Each User profile also enables the definition and management by CS Associados of the access permissions to the Platform contents valid at any time for any single User.

Collected Personal Data – by allowing User registration on the Platform through the creation of a User Account and the definition of a personal profile – is processed by CS Associados with the purpose of granting and managing Users’ permissions to access the Platform and its contents.

Collected Personal Data shall not be used for any other purpose.

Collection and Processing of Personal Data

Users’ Personal Data is collected, with consent, in person, by phone, by email or through the Platform.

The Personal Data subject to collection and processing include, mandatorily, the User’s name, academic degree, email address, indication of the respective entity/organization as well as job title, and, optionally, the User’s mobile phone number.

Without the Personal Data subject to mandatory collection it is not possible for the User to complete the set-up of a User Account, nor benefit from access to the Platform and its contents.

As a rule, Users’ Personal Data is collected, with consent, at the moment of each User’s first access to the Platform. Delivery to each User of an invitation (link) for the first access to the Platform requires the prior collection and processing, with consent, of the Personal Data necessary for such purpose (such as name and email address), subject to confirmation by the User at the time of setting-up his/her User Account.

Responsibility for Personal Data Processing

CS Associados is the entity responsible for the collection and processing of Personal Data. Collected Personal Data is processed automatically by software and in compliance with the applicable legal and regulatory provisions (including the Personal Data Protection Act).

CS Associados is the sole responsible for managing the access and consultation permissions to the Platform and its contents granted to each User.

Collected Personal Data shall not be shared or transmitted by CS Associados to any third-party.

Security of Users’ Personal Data

CS Associados undertakes to procure the protection, security and confidentiality of the Users’ Personal Data collected and processed pursuant to the Privacy Policy.

For such effect, CS Associados adopted several security measures of technical and organizational nature, with the objective of protecting the Personal Data collected within the management of accesses to the Platform against their unauthorised disclosure, loss, improper use, modification, handling or access, as well as against any other form of illicit access.

Users’ Personal Data is stored in servers with limited access and within controlled facilities. The Platform uses SSL (Secure Socket Layer) technology, a security feature that consists on encrypting the communications made between the Users’ computers and the server where the Platform is stored.

However, collection of Personal Data in open networks (namely online through the internet) means that such information may circulate on the network without security measures, and therefore, there is a risk that the data may be viewed and used by unauthorised third-parties. In this event, CS Associados shall not be liable for the theft, destruction or disclosure of Users’ Personal Data.

Cookies

Cookies are text files that identify the Users’ computers in our servers, but not the individual Users themselves, which are used to enhance Users’ experience, as well as to permit a more efficient browsing. Cookies are not used to collect Personal Data, and therefore all gathered and shared information is anonymous.

The Platform may place a Cookie in the hard drive of the equipment used by the User to access the Platform in order to recognized the User and to ensure personalised access. For such purpose, the Platform uses the following Cookies:

“Sessionid”: Stores a hash that enables Users’ authentication and the language preferences of each User. This Cookie expires after 15 days.

“Csrftoken”: Stores, for security purposes, a single hash per browser session that prevents any form of the Platform from being used with malicious intent on other websites.

All web browsers may be configured to accept, refuse or delete Cookies, as well as to alert Users whenever Cookies are being sent. However, if a User does not accept Cookies, some parts of the Platform may not operate properly.

Access, Update and Rectification of Personal Data

Any User may request the access, update, rectification, deletion or blocking of the respective Personal Data, as well as oppose to treatment thereof.

Pursuant to the applicable legal provisions, Users may also, at any time and according to reasonable criteria, request additional information regarding the personal data collection, storage and processing practices of CS Associados within the Platform access management, as well as regarding the purposes for which the data is collected.

Amendments to the Privacy Policy

CS Associados reserves the right to amend this Privacy Policy at any time.

In case of amendment to this Privacy Policy, the date of the latest amendment of the Privacy Policy indicated at the top of the page shall be updated. CS Associados shall notify Users of any material amendments to the Privacy Policy by any means deemed suitable, including by placing a specific notice or warning on the Platform.

Contacts and Cancelation of User Account

Should you intend to (i) place any queries or comments regarding our Privacy Policy; (ii) update or rectify your Personal Data; or (iii) opt-out/withdraw your consent for the processing of your Personal Data (which will trigger the cancelation of your User Account and the termination of your access to the Platform), you may do so to any of the following contacts:

Applicable Law and Jurisdiction

The Privacy Policy, as well as the collection and processing of Users’ Personal Data, are governed by the laws of Portugal.

Any conflicts arising out of or related with the validity, interpretation or execution of the Privacy Policy, or related with the collection, processing and transfer of Users’ Personal Data, shall be submitted to the exclusive jurisdiction of the courts of Lisbon, without prejudice of a mandatory legal provision setting forth otherwise.
